Wholesale Aquatic Supplies 1. Legal; Terms of Sale TERMS OF SALE 1. Warranty: As a master distributor and not a retailer, we do not exchange, refund, warranty or guarantee any product what so ever implied or otherwise. Warranties are extended only to what the manufacturer of the merchandise provides. Please follow the instructions on your warranty paper work provided in your package. 2. Manufacturer Warranty: We are not responsible for any claims made by the manufacturer. If the manufacturer indicates your retailer will help process this claim, we will be happy to make the call for you and see what the manufacturer requires of you to process the claim. We will do everything we can to help but the customer will be fully responsible for all shipping costs too and from the manufacturer, us or any other expenses such as but not limited to parts replacements not covered by the warranty if required. 3. Exchange: If in the event, an exchange is allowed, the customer again assumes all shipping responsibility. 4. Refund: If a refund is granted under special circumstances, a restocking fee of 30% will be charged and the shipping & handling will not be refunded. 5. UPS Shipping Damage: Inform us in writing within 3 business days and we will process a UPS Damage Claim for you. An inspector will typically pick up the item within 5 business days. The item “must” be packed in it’s original packaging with all padding originally arrived in. Once the claim has been processed, the item returned to us and only after it is approved will we then process an exchange and have a replacement sent right out. 6. Air Cargo Shipping Damage: All items shipped via Air Cargo is insured for shipping damage. When picking your item up at your local international HUB, you are asked to inspect the item prior too signing the air bill and insurance waiver. If everything arrived in acceptable condition, sign the air bill. If not, “Do not sign the air bill” as this is a waiver of your insurance indicating everything was received in perfect condition and nothing further can be done too process a claim after the fact. 7: Vender Changes: We are always looking for either a better quality vender to go through to increase quality but lower price to our customers and where possible, we will carry our own product line. Our product line has changed over the years but some pictures, video, verbiage or other may have not yet been updated. Please be aware of this. One example of this is where we sell both our very own brand of Oceanpro Aquatics™ Live Rock but will also offer Walt Smith live rock. If the ad or item indicates it is Oceanpro Aquatics™, then we may show you an example of our live rock via video but if the video shows an image or discussion of it being of Walt Smith™ brand, just know what you are purchasing is what is advertised and the video or picture is just made available as a tool to give you an idea of what our live rock looks like. This also vise versa applies. If we sell are offering a special on Walt Smith™ Rock, we may use video or pictures of our very own live rock. Simply put, there are some photos or video that need too be updated but are accurate in the example that is shown. As with all live rock, rock is rock and no two are identical. These are not molds and will vary no matter the vender. Please see paragraph 8. Another example may be of our Oceanpro Aquatics™ Fish Feeders which are virtually identical to the Eheim Fish Feeder. We carry and private many products that are very similar too one brand but offer them both either under our money saving private label or you may buy the brand name. In most cases such as with our live rock, fish feeders, nano tanks, etc, many items are nearly identical. Just be aware of the brand you are purchasing and know that the item may be different from that of the picture. Call our Customer Support center at (404)418-8794 to resolve any questions before ordering. 8: Live Stock Quality Guarantee: As mentioned in paragraph 1, as is normal with most distributors, we are not responsible nor do we carry any warranty on any item. However, as mentioned in paragraph 5-6, we will help in the event an insurance claim is necessary. In other words, when buying live rock, sand or other from us, we are very clear to indicate that if an item is damaged, we will help resolve this problem with an exchange only after an insurance claim is made (see paragraphs 1-6 and 9) in the event damage occurs in transit such as but not limited too the live stock arriving dead, in bad shape due to neglect or mishandling by the courier service used, etc. Keep in mind that for instance, there are certain things too be aware of when purchasing livestock. It is alive and not a mold! Things vary (see paragraph 10) and the sale is made for the item. 9. Warranty Exchange Shipping Responsibility: If any shipping is required such as but not limited too the return of an item or the reshipment back too the customer in the event of a claim if not covered by the manufacturer, the customer assumes all financial liability for such shipments and/or any other charges. 10. Live Rock Quality: Our rock is exclusively shipped by Air directly from the islands to us at LAX in Los Angeles, California which is the only hub in the USA to get Fiji Rock direct. Our rock never sits in our warehouse for more than a day or two in our curing tanks before we are completely sold out, insuring every delivery to be the very best it can be. The only reason we can sell our rock so inexpensively is because we are the collectors and distributor, not the middle man. We only sell too the public on occasion for promotional. Unless explicitly expressed otherwise, we almost exclusively sell Oceanpro Aquatics™ Rock only to which most all customers agree, others pale in comparison. If specifically requested, we will sell other brand names such as Walt Smith or other live rock, but prices will change! With our rock, we utilize a special cleaning and curing process which further insures that in 24 years of business specializing in import / export of corals, live rock, live sand, tropical fish and aquarium products from around the world, we boast that our rock has never harbored unwanted Aptasia nor Mantis Shrimps as others (especially Florida Rock) often do. All rock will vary in but not limited too shape, size, color, density, life, coralline algae, plant life, animal life and live coral growth typically vary by the season, region of collection, depth of collection, weather conditions when collected, etc. One thing is certain as can be seen in our feedbacks on popular forum boards, chat rooms, eBay feedbacks, and customer reviews on our home site shopping center and that is everyone finds our rock too be the best found anywhere! One thing "will" affect the quality of your rock and that is how fast you ship it. Although the majority of our customers ship via UPS Ground (UPS Standard for international customers) just excepting the fact there will be less color or life and more recurring required (not a huge issue, especially when setting up a brand new tank), next day or over night air cargo shipping is the only method we recommend. 11. Caveat emptor: Caveat emptor. The axiom or principle in commerce that the buyer alone is responsible for assessing the quality of a purchase before buying. All items are “sold as is” unless guaranteed otherwise in writing. 12. Legal Contractual Changes: Our terms of agreement such as but not limited too shown here in our knowledge base, our website, on eBay, in any advertisement, verbal, or else, may change at anytime without prior notice by Oceanpro Aquatics, Inc. and are legally binding as doing business with us is the same as signing a contractual binding contract and you understand these terms without reserve prior too making any commitment too any purchase. 12.
